Suzy technically Sauske hasn't done anything wrong. He hasn't broken any laws so he could still come back. Also if he did come back Tsunade would be ok with it so that's how it would go.
Also not sure if you understood. Jugo wasn't a test subject for the curse mark. The curse mark originated from him.

I'll allow myself to disagree.
First- In Naruto world Shinobi cannot leave a village vithout a permission. That is to prevent leak of information. Sasuke did that so he is a criminal.
Second- He joined the man who was kidnaping people from the village do make experiments on them, attack the village with a whole army and finally killed their Hokage.

Except he left to join and train with the enemy. No one knows what secrets he may have told the enemy about the leaf during that time. Also, he was a child and was not allowed to leave the leaf without authorization. So he is in fact a rogue ninja and enemy of the leaf.
Sasuke almost killed Naruto and teamed up with a known criminal who has attacked the leaf village and killed their hokage. So yeah...wouldn't really trust him to come back. That being said Naruto and Sakura probably figured that Sasuke betrayed Orochimaru for the Leaf and that he switched sides. So I guess they hoped he saw the light again.
That's not how the world in Naruto works. It's illegal to leave your village without permission (as a ninja at least). This is probably to prevent traitors from leaking info among other reasons. There are even squads that villages send out to retrieve missing nin, sometimes even by killing them (like who Haku was impersonating).
I mean just a couple of more minutes for us to see you ;_;
